Licence d'Utilisation Publique Non Commerciale sans Intelligence Artificielle (LPNC-IA 1.0)

1. Définitions

• « API » désigne l'interface de programmation applicative publique mise à disposition par le Titulaire pour accéder aux données du jeu Dofus.
• « Titulaire » désigne la personne ou l'entité qui publie et maintient l'API.
• « Utilisateur » désigne toute personne physique ou morale qui accède à l'API ou utilise les données issues de celle-ci.
• « Projet » désigne toute application, site web, script, outil, service ou œuvre dérivée utilisant tout ou partie des données fournies par l'API.
• « Intelligence Artificielle (IA) » désigne tout système automatisé d'apprentissage machine, réseau de neurones, modèle de langage (LLM), outil de génération de contenu, ou tout système similaire capable de produire, compléter, transformer ou analyser du contenu de manière automatisée.

2. Droits accordés

Sous réserve du respect des présentes conditions, le Titulaire accorde à l'Utilisateur un droit non exclusif, non transférable, mondial, gratuit de :

• Accéder aux données fournies par l'API ;
• Intégrer ces données dans des Projets à des fins strictement non commerciales ;
• Partager et distribuer des Projets basés sur ces données, dans le respect des présentes conditions.

3. Conditions obligatoires

3.1 Attribution
Tout Projet utilisant l'API doit clairement mentionner l'attribution suivante dans un endroit visible (page d'accueil, documentation, mentions légales, fichier README ou équivalent) :

« Données issues de DofusDB. Utilisation soumise à la LPNC-IA 1.0. »

3.2 Partage dans les mêmes conditions
Tout Projet dérivé doit être distribué sous les mêmes termes que la présente licence ou sous une licence compatible.

4. Restrictions

4.1 Usage non commercial
Il est strictement interdit d'utiliser l'API ou les données issues de celle-ci à des fins commerciales, notamment :

• Vente directe ou indirecte de données ou de services basés sur ces données ;
• Monétisation via publicité, abonnement payant ou tout autre modèle économique ;
• Intégration dans un produit ou service commercial.

4.2 Restrictions liées à l'Intelligence Artificielle
L'utilisation d'outils d'IA à titre ponctuel et accessoire (autocomplétion, suggestion de code, correction orthographique, etc.) est tolérée, à condition que l'Utilisateur reste l'auteur principal et responsable du Projet.

En revanche, il est strictement interdit :

1. De générer un Projet majoritairement par IA : tout Projet dont la structure, le code, le contenu ou la logique a été produit en majorité (plus de 50 %) par des outils d'IA est exclu du champ de cette licence ;
2. D'utiliser les données de l'API pour entraîner ou affiner (fine-tuning) tout modèle, système ou algorithme d'IA ;
3. D'intégrer l'API dans un pipeline automatisé piloté par l'IA sans intervention humaine significative ;
4. De rendre les données disponibles à tout système d'IA, agent autonome ou bot d'apprentissage automatique.

En cas de doute sur le seuil « majoritaire », l'appréciation est laissée à la bonne foi de l'Utilisateur. Le Titulaire se réserve le droit de révoquer la licence si un usage contraire à l'esprit de cette clause est constaté.

5. Absence de garantie

L'API est fournie « en l'état », sans garantie d'aucune sorte, explicite ou implicite. Le Titulaire ne saurait être tenu responsable de tout dommage direct ou indirect résultant de l'utilisation de l'API.

6. Résiliation

La présente licence est automatiquement résiliée en cas de violation de l'une de ses conditions. En cas de résiliation, l'Utilisateur doit cesser immédiatement tout accès à l'API et supprimer les données issues de celle-ci de ses Projets.

7. Droit applicable

La présente licence est régie par le droit français. Tout litige sera soumis à la compétence exclusive des tribunaux français.

🇬🇧 ENGLISH VERSION

Non-Commercial Public Use License — No Artificial Intelligence (NCPUL-AI 1.0)

1. Definitions

• "API" means the public application programming interface made available by the Licensor to access Dofus game data.
• "Licensor" means the individual or entity that publishes and maintains the API.
• "User" means any individual or legal entity that accesses the API or uses data obtained from it.
• "Project" means any application, website, script, tool, service, or derivative work using all or part of the data provided by the API.
• "Artificial Intelligence (AI)" means any automated machine learning system, neural network, large language model (LLM), content generation tool, or similar system capable of producing, completing, transforming, or analyzing content in an automated manner.

2. Granted Rights

Subject to compliance with these terms, the Licensor grants the User a non-exclusive, non-transferable, worldwide, royalty-free right to:

• Access the data provided by the API;
• Integrate this data into Projects for strictly non-commercial purposes;
• Share and distribute Projects based on this data, in accordance with these terms.

3. Mandatory Conditions

3.1 Attribution
Any Project using the API must clearly include the following attribution in a visible location (homepage, documentation, legal notices, README file, or equivalent):

"Data sourced from DofusDB. Use subject to NCPUL-AI 1.0."

3.2 ShareAlike
Any derivative Project must be distributed under the same terms as this license or under a compatible license.

4. Restrictions

4.1 Non-Commercial Use Only
It is strictly prohibited to use the API or data derived from it for commercial purposes, including but not limited to:

• Direct or indirect sale of data or services based on this data;
• Monetization through advertising, paid subscriptions, or any other business model;
• Integration into a commercial product or service.

4.2 Restrictions Related to Artificial Intelligence
The use of AI tools on a minor and incidental basis (autocompletion, code suggestions, spell checking, etc.) is permitted, provided that the User remains the primary author and responsible party for the Project.

However, the following are strictly prohibited:

1. Generating a Project predominantly through AI: any Project whose structure, code, content, or logic has been produced in majority (more than 50%) by AI tools is excluded from the scope of this license;
2. Using the API's data to train or fine-tune any AI model, system, or algorithm;
3. Integrating the API into any AI-driven automated pipeline without meaningful human intervention;
4. Making data available to any AI system, autonomous agent, or machine-learning bot for ingestion or learning purposes.

In case of doubt regarding the "majority" threshold, this is left to the User's good faith. The Licensor reserves the right to revoke the license if a use contrary to the spirit of this clause is identified.

5. Disclaimer of Warranties

The API is provided "as is", without warranty of any kind, express or implied. The Licensor shall not be held liable for any direct or indirect damages resulting from the use of the API.

6. Termination

This license is automatically terminated upon violation of any of its terms. Upon termination, the User must immediately cease all access to the API and remove data derived from it from their Projects.

7. Governing Law

This license is governed by French law. Any disputes shall be subject to the exclusive jurisdiction of French courts.
